Sunday Premium Pay Rules in Ireland

## The legal basis Section 14 of the Organisation of Working Time Act 1997 entitles an employee required to work on a Sunday to compensation. The form of compensation can be: - A reasonable allowance, or - Reasonable enhanced rate of pay, or - Reasonable paid time off, or - A combination Most employers pay an enhanced hourly rate for Sunday hours. ## What counts as reasonable The Act does not specify a percentage. Court and WRC decisions have generally accepted: - Time and a third (33 percent premium) as a minimum reasonable amount - Time and a half (50 percent premium) as common practice - Double time (100 percent premium) in industries like retail and hospitality with collective agreements ## Where the contract is silent If the contract or pay slip does not show how Sunday premium is calculated, the WRC may find that the basic rate is too low and order back pay. ## Worked example, time and a third Niamh earns €14.15 per hour. She works 8 hours on Sunday. - Standard pay: 8 x €14.15 = €113.20 - Sunday premium (33 percent): €113.20 x 33 percent = €37.36 - Total Sunday pay: €150.56 Or expressed as enhanced hourly rate: €18.83 per hour. ## Worked example, time and a half Same Niamh on a time and a half premium: - Enhanced rate: €14.15 x 1.5 = €21.23 per hour - 8 hour Sunday: €169.84 ## When premium does not apply The Sunday premium is not required where: - The employee's basic pay already takes into account that Sundays are normal working days, and the contract states this explicitly - The employee is in a job category where Sunday work is a fundamental part of the role and contract pay reflects this ## Sunday and public holiday combined If a Sunday is also a public holiday, both entitlements apply: Sunday premium for the work performed plus public holiday pay or time off. ## Tax treatment Sunday premium is treated as ordinary employment income.
